Atorym coordinates the delivery of building materials to commercial customers throughout our designated service area. This Shipping & Delivery Policy explains how delivery charges, scheduling, job-site requirements, delays and delivery issues are handled.

This Policy forms part of the Atorym Terms. If there is any conflict between this Policy, an Atorym Quote or Order Confirmation, and the Terms, the applicable Quote or Order Confirmation will govern with respect to order-specific delivery terms, followed by the Terms.

1. ORDER PROCESSING AND DELIVERY STATUS

Once your Order has been accepted by Atorym, we will coordinate product fulfillment and delivery.

Processing and delivery times vary depending on product availability, supplier lead times, order size, delivery location and transportation requirements.

Any delivery date or time provided by Atorym is an estimate unless expressly confirmed by Atorym in writing as guaranteed.

We will provide delivery updates using the contact information associated with your Order. Customers are responsible for ensuring that their account, job-site and contact information is accurate and current.

2. DELIVERY AREA

Atorym currently provides delivery throughout the Greater Toronto Area and selected surrounding areas.

Delivery availability is determined using the delivery address submitted with the Order and may vary based on product, shipment size and transportation requirements.

Our service area may expand or change from time to time.

If a delivery address falls outside our standard service area, please contact us to determine whether delivery can be arranged.

3. DELIVERY CHARGES

Delivery charges are determined based on factors such as:

  • delivery location;
  • shipment weight and dimensions;
  • order volume;
  • equipment requirements;
  • pickup location;
  • job-site access requirements; and
  • other transportation considerations.

Applicable delivery charges will be identified in your Atorym Quote before you place the Order.

Additional charges may apply if the delivery requirements change after the Order has been accepted, including changes to the delivery address, requested delivery timing, equipment requirements or site conditions.

4. DELIVERY SCHEDULING

Commercial deliveries are generally scheduled during normal business hours, Monday through Friday, excluding statutory holidays.

Where possible, Atorym will provide an estimated delivery date or delivery window in advance.

Delivery times are not guaranteed unless expressly agreed by Atorym in writing.

Carrier arrival times may be affected by traffic, weather, prior deliveries, job-site conditions and other circumstances outside Atorym's reasonable control.

5. JOB-SITE ACCESS AND RECEIVING REQUIREMENTS

The Customer is responsible for ensuring that the delivery location is ready to receive the shipment.

Unless otherwise agreed, the Customer must ensure that:

  • an authorized person is available to receive the delivery;
  • the project is safely and legally accessible by the applicable delivery vehicle;
  • any required gates, loading areas or access points are available;
  • appropriate unloading equipment and labour are available where required;
  • Atorym is advised in advance of material access restrictions, construction conditions or special delivery requirements; and
  • all delivery information provided to Atorym is complete and accurate.

Drivers and carriers are not required to enter an area they reasonably consider unsafe or inaccessible.

Unless expressly included in the Quote, delivery does not include unloading, hoisting, craning, material placement, installation or movement of Products within the project.

6. FAILED DELIVERIES, WAITING TIME AND REDELIVERY

If a delivery cannot be completed because:

  • no authorized recipient is available;
  • the site is inaccessible;
  • unloading equipment or labour is unavailable;
  • incorrect delivery information was provided;
  • the Customer refuses the shipment without valid cause; or
  • another Customer-controlled condition prevents delivery,

the Customer may be responsible for reasonable additional costs incurred, including waiting time, return freight, storage and redelivery charges.

Any such charges will reflect the costs reasonably incurred by Atorym in connection with the unsuccessful delivery.

7. PARTIAL OR SPLIT DELIVERIES

Where reasonably necessary due to product availability, supplier location, shipment size or transportation requirements, an Order may be delivered in more than one shipment.

Atorym will make reasonable efforts to communicate material changes to the expected delivery arrangement.

The Customer will not be charged additional freight solely because Atorym elects to split an Order after acceptance unless the Customer agrees to the additional charge or the split results from a Customer-requested change.

8. DELIVERY CHANGES

Requests to change a delivery address, delivery date or other delivery requirement after an Order has been accepted should be submitted to info@atorym.com as soon as possible.

Atorym will make reasonable efforts to accommodate requested changes but cannot guarantee that a change can be made once Products have been prepared for shipment or transportation has been arranged.

Changes may result in additional freight, handling, storage or other charges.

9. INSPECTION, SHORTAGES AND DAMAGE

Customers should inspect shipments promptly upon delivery.

Where reasonably possible, visible damage, shortages or incorrect Products should be noted on the carrier's delivery receipt or proof of delivery before the shipment is accepted.

Please report:

  • visible transportation damage;
  • shortages;
  • incorrect Products; or
  • other apparent discrepancies

to info@atorym.com promptly and, where reasonably possible, within two (2) business days of delivery.

Damage or defects that could not reasonably have been identified at delivery should be reported promptly after discovery.

Please retain the affected Products, packaging and delivery documentation until Atorym provides further instructions. Photographs may be requested to assist with investigation and resolution.

Reporting an issue promptly helps Atorym pursue any applicable carrier, supplier or manufacturer claim.

10. DELIVERY DELAYS

Atorym works to coordinate deliveries according to the estimated timing communicated with each Order. However, construction-material deliveries may be affected by circumstances outside our reasonable control, including:

  • product shortages;
  • manufacturer or supplier delays;
  • transportation interruptions;
  • severe weather;
  • traffic or road closures;
  • labour disruptions;
  • government restrictions;
  • job-site conditions; and
  • other supply-chain events.

Atorym does not guarantee delivery dates unless expressly agreed in writing.

Customers should plan procurement with appropriate lead time and should not schedule labour or other project activities solely in reliance on an estimated delivery date.

11. SINGLE DELIVERY LOCATION

Unless otherwise agreed in writing, each Order is quoted for delivery to the single delivery address identified in the applicable Quote.

Requests for multiple delivery locations or stops may require separate Quotes and additional delivery charges.
